What is a “case evaluation”?

A case evaluation is a thorough analysis and clear recommendations on next steps. Our goal is to provide you with peace of mind, meaning we are invested your situation and the outcome.

Case evaluations are a critical step in our process wherein we review your provided materials in advance of the consultation, review relevant precedents, attend the consultation and respond to follow-up questions. Each matter is unique, and there is no one-size fits all approach for each case evaluation. After receiving necessary details from you, we’ll do our best to provide you with a cost estimate to give you an understanding of fees in advance of the consultation. If you would like your case evaluation to be in person or by video-call, please let us know and we will accommodate this request.

This is the right question to ask, and we respect that you are doing your research. A few things set us apart. First, our lawyers are all passionate about employment law. Everyone at Cashion Legal has chosen to work in this practice area because we believe in the importance of bringing clarity to people’s working lives. Second, our team-based approach is key. At our firm, our lawyers collaborate on all of our files, which helps ensure that our clients get the best advice. Third, we are focused on bringing you clarity, explaining your options, and giving you peace of mind. We will always give you an honest assessment of your situation with a view to advancing your preferred outcome.

All lawyers at Cashion Legal focus on Alberta employment law. That includes matters like wrongful dismissal, constructive dismissal, severance negotiation, termination for cause, non-competition and non-solitication agreements, workplace harassment, and human rights issues.

Our lawyers work collaboratively including in advance of case evaluations, so every client gets the benefit of the team’s collective expertise. You are not relying on one person working in isolation. Junior lawyers are supported by senior lawyers throughout a file, which means the experience of the whole firm is behind your matter from the start.

Many firms that advertise free consultations are looking to sign contingency fee clients. The consultation itself is often a sales call, and the advice given may be limited accordingly.

At Cashion Legal, the case evaluation is a paid service because it is substantive legal advice specific to your matter. You will speak with a lawyer who has reviewed your situation, can give you an honest assessment of your options, and will help you understand what your rights actually are under Alberta law. That is worth something.

After receiving necessary details from you, we’ll do our best to provide to a cost estimate to give you an understanding of fees in advance of the consultation. Many clients find that even a single case evaluation gives them the clarity they need to make an informed decision about next steps.

Fees for consultations will vary firm by firm based on a number of factors. At Cashion Legal we provide case evaluations for workplace and employment law that provide our clients with clarity, strategy and peace of mind in their matter. This case evaluation involves a review of your provided materials and involves a discussion with you and one of our employment lawyers.

We understand wanting a general sense of costs before committing. We are not able to provide a firm fee estimate before a case evaluation because the work involved varies significantly depending on the facts, the other party, and the strategy that makes sense for your situation.

Each matter is unique, and there is no one-size fits all approach for each case evaluation. After receiving necessary details from you, we’ll do our best to provide to a cost estimate to give you an understanding of fees in advance of the consultation and beyond.

If cost is a concern, please let us know. The lawyer can tailor the conversation to focus on the most cost-effective approach for your circumstances.

Our hourly rates range from $315 to $550, depending primarily on the lawyer’s years of experience. What that range does not reflect is the collaborative way we work. Junior lawyers on a file are supported by senior lawyers throughout, so you are getting the benefit of the team regardless of who is billing your matter. In many cases, that structure is also more cost-effective for clients.

If you proceed beyond the case evaluation, the lawyer will discuss fee arrangements and provide a written engagement letter before any additional work begins.

In some circumstances, yes. Contingency fee arrangements mean the lawyer is paid a percentage of any recovery rather than billing by the hour. They are not available for every type of matter, and they are not the right fit for every client or situation.

Whether a contingency arrangement is appropriate depends on the strength of the claim, the likely recovery, and other factors that we can only assess after reviewing your situation.

We are not able to make that determination without understanding the details of your situation. A contingency assessment requires the same information a lawyer would need to evaluate your claim generally. That review happens in the case evaluation.

What we can say is that if a contingency arrangement turns out to be appropriate based on what the lawyer learns, that option can be discussed during the case evaluation itself.

Our intake team can help determine whether your situation falls within the types of matters we handle, but we are not able to assess the strength of a legal claim over the phone or by email. That requires a lawyer.

Employment law claims depend on the specific facts of your situation, your employment history, your contract, and a number of other factors. Even situations that sound straightforward on the surface can have important nuances.

The case evaluation is the right place for that assessment. Many clients find they leave with a much clearer picture than they expected, even if the answer is not exactly what they hoped for.

Not at all. We serve clients across Alberta. Case evaluations can be conducted by phone or video, so your location within the province is not a barrier. All we need is that your employment situation is governed by Alberta law.

If you are unsure whether Alberta law applies to your situation (for example, if you work for a federally regulated employer such as a bank or airline), let us know and we can help clarify.

Yes. Information you share with our firm in the context of seeking legal advice is treated as confidential. This applies whether the communication happens by phone, email, or in person.

It is worth knowing that full solicitor-client privilege formally attaches once a lawyer-client relationship is established, which typically happens once you retain the firm. However, information shared during an intake call or case evaluation is still treated with care and discretion.

If you have specific privacy concerns, you are welcome to raise them directly with the lawyer during your case evaluation.
