If an employee is on an approved maternity or paternity leave under Alberta’s Employment Standards Code, the employment cannot be terminated while the employee is on leave. Further, once the leave is over the employer has certain obligations about allowing the employee to return to their former role under the Alberta Human Rights Act.

Generally speaking the employer is required to reinstate the employee to their original position or a comparable position upon return from each maternity leave. The employee is protected from any form of discrimination or unfair treatment due to pregnancy under the Alberta Human Rights Act. If the employer attempts to alter employment terms negatively because of pregnancy or maternity leave, this could constitute discrimination.

Absent exceptional circumstances, an employer cannot ask an employee if they are, or intend to, get pregnant.
